Access
One requirement for acceptance into this program at the Miguel Hernández University of Elche will "be in possession of a Law degree or any other equivalent university bachelor's degree that meets the requirements established in Article 3 of this regulation." This is expressly provided for in Art. 2.1. a) of Real Decreto 775/2011, of 3 June, through which the Regulations of Law 34/2006, of 30 October, concerning access to the professions of Barrister and Lawyer, are approved. These requirements are the following (Art. 3 Regulations):
"1. University undergraduate degrees referring to point a) in Article 2 must certify the acquisition of the following legal competences:
a) Know and understand the elements, structure, resources, interpretation, and application of law and interpret the basic legal sources and concepts of each of the different legal orders.
b) Know and understand the mechanisms and procedures for resolving legal conflicts, as well as the legal position of individuals in their relationships with the government and in general with public authorities.
c) Understand and know how to apply precedence criteria to sources in order to determine the regulations that are applicable in each case, particularly that of conformity with constitutional regulations, principles, and values.
d) Interpret legal texts from an interdisciplinary perspective, using legal principles and social, ethical, and deontological values and principles as analysis tools.
e) Pronounce a convincing legal argument on a theoretical question relative to different legal material.
f) Solve practical cases under the positive law in force, meaning prior preparation of material, the identification of problematic questions, selection, and interpretation of the applicable positive law, and reasoned exposition of subsumption.
g) Manage the legal language and terminology belonging to the various branches of law skillfully and accurately: write legal documents orderly and understandably. Express legal ideas, arguments, and reasoning orally and in writing using the proper records in each context.
h) Use information and communications technology to search for and obtain legal information (legislation databases, jurisprudence, bibliography, etc.), as well as for work and communication tools."
In any case, deemed to fulfill these requirements will be: " ...university undergraduate degrees that at the time this regulation comes into effect have obtained, in accordance with that established in articles 24 and 25 of Real Decreto 1393/2007, of 29 October, by which the organization of official university education is established, a positive verification resolution by the Universities Council with the designation of graduate in Law" (Art. 3.3 Regulations).
Admissions
There are no additional admissions requirements beyond those provided here.
In the event that the number of applications exceeds the number of places available, the grade point averages of the Law degree candidates will be considered for admission purposes. The Master's Academic Committee, in which case, may also give preference to applicants who need to complete this master's program in order to practice law professionally over those who are or who may become licensed without needing this graduate degree in order to obtain the professional degree of lawyer in accordance with the Access Law. The Academic Committee shall have the composition that was envisaged in the institutional collaboration agreement by those creating it.
Pursuant to the provisions in Article 17 of Real Decreto 1393/2007, 5% of the places available will be reserved for students with disabilities.
